all applicable laws and regulations governing use of the Site. NAGCC reserves the right to change
these Terms of Use at any time, effective immediately upon posting on the Site. In case of updates
in these Terms of Use, we will notify the updates at the bottom of the Site NAGCC reserves the right
to stop your use of the site, prevent you from using it future, and/or take necessary legal action
against you if you breach these terms of usage.

NAGCC controls this Site from the UAE. NAGCC makes no representation that this Site is
appropriate for use in other locations. If you use this Site from other locations, you are
responsible for ensuring compliance with local laws.
Purchases
The payment for our products and services can be made by Net Banking or Bank Transfer in USD and
AED. All the online purchases are governed by the terms and conditions of respective merchant
service providers. Please review the respective merchant service provider’s user agreement and
privacy policy before entering into any transaction. A waiver or modification of these Terms of
Use will only be effective if made in writing signed by an authorized officer of NAGCC. All
refunds will be made onto the original mode of payment.

Our Site may contain links to third-party websites or services that are not owned or controlled
by NAGCC.
We have no control over, and assumes no responsibility for, the content, privacy policies, or
practices of any third party web sites or services. You further acknowledge and agree that NAGCC

alleged to be caused by or in connection with the use of or reliance on any such content, goods

inclusion on the Site will not plagiarize, violate or infringe upon the rights of any
third-party including trade secret, copyright, trademark, trade dress, privacy, patent, or other
personal or proprietary rights. Customers who are minors or under the age of 18 are not allowed
to register as users of the Site, conduct transactions or otherwise use the service.

NAGCC reserves the right at all times to prohibit or deny your access to the Website or any part
thereof immediately and without notice, where we are of the opinion that you have breached any
of the terms contained in the Terms of Use or that such prohibition or denial is appropriate,
desirable or necessary in our sole discretion.
Whilst we implement appropriate security measures to control access to the Website (please see
our Privacy Policy Statement for further details), you must keep your log-in details (if any)
confidential and ensure that only you or your authorized employees access the Services for
proper purposes.
Third-Party Information
The Information may contain Information provided by Third Party Providers or sourced by NAGCC
from other references or sources. The Information on the Website may not be regarded as any
recommendation or endorsement by NAGCC for any purpose with respect to any person, product, or

NAGCC is not responsible if any such Information is not up to date; NAGCC does not separately
verify such Information. Accordingly, we do not accept any responsibility whatsoever in respect

the views of or any endorsement by NAGCC. You are cautioned as to the reliability and accuracy

No Commercial Use
This Site may not be used by you for any commercial purposes such as to conduct sales of
merchandise or services of any kind. Any commercial offers of any type, whether through
advertising, solicitations, links, or any other kind of communication, must be with the consent
and prior written approval of NAGCC. Anyone who violates this provision, NAGCC may investigate
and take appropriate legal action against such violation including without limitation, removing
the offending communication from the Site and barring such violators from use of the Site.
Returns And Refunds
This section applies to purchases made through the NAGCC platform that are sold directly by
NAGCC, the Buyer may request a refund only if:

the goods are defective, damaged, or non-conforming to their description as stated on the
NAGCC Platform (provided that the Buyer has notified NAGCC within 24 hours and in accordance
with the following sections), or
- if NAGCC is unable to fulfill the order or substitute the goods with the same or similar
goods to the satisfaction of the buyer.
A refund request shall be made by the Buyer in writing in accordance with the provisions set out
below:
- Return and Refund Eligibility
Unless further restrictions apply as specified in the sections below, or otherwise
specifically agreed in writing between the Buyer and NAGCC, the following are acceptable
reasons to return a Product, and, or, request a refund in relation to said product:

Product packaging is faulty, defective or damaged, or not as advertised/described.

The product does not conform with the description or specifications advertised by
the Seller.

Product or order specifications do not meet the advertised specifications or
requirements.

The product is not shipped in accordance with the agreed shipping method or to the
agreed address.

Product is counterfeit/fake.
-
Product is expired (perishable products are not included)

Delivery of the Product is delayed, without prior notice and, or, without a
justified reason ( e.g. force majeure)

When the Product ordered from NAGCC is out of stock or otherwise becomes unavailable
by NAGCC’s own suppliers

Increase in price of the Product during the fulfillment process (if you place an
order and the price was changed/not updated by the seller)

Return Period
Where a Product is eligible for return, and subject to the terms and conditions set out in
this Policy:
- Frozen items, fresh foods, or chilled foods and beverages must be inspected at the
time of receipt. If Buyer wishes to return a Product, Buyer must immediately return
the Product to NAGCC’S delivery agent within 24 hours; and

For all other Products, the Buyer must inform NAGCC within 24 hours of delivery, in
writing, of its intent to return the Products.
If no notice is received within the above mentioned time frame, the Buyer will be considered
as having accepted the Products, as is, and without objection.

How to Initiate a Return
To initiate a return you must, within the Return Period, notify NAGCC in writing describing
the damage, non-conformity, or other reason for return in sufficient detail as to enable
NAGCC to make a claim to its Supplier or otherwise seek corrective action. The notification
shall be made via email to NAGCC’s Customer Service at info@nigeriatradehouse.com to submit
a
return or refund request by quoting the:
Order or transaction ID;
Order value; and
Reason for return, including wherever possible or required under this Policy, evidence to
support the claim, such as pictures or reports from third parties.
Upon receipt of the email, the NAGCC’s customer service team will investigate the claim and
advise whether the Products are eligible for return and refund under this Policy.
If the return and refund request is approved, the Customer support team will create a Return
ID, and initiate the necessary actions to process the return and the refund in accordance
with the terms contained in this Policy.

Packing and Sending Returns
When a Product is eligible for return and refund, please make sure to carefully repackage
the item in its original condition, including all original packaging and materials
(instruction manuals, accessories, etc.) If a Product is being returned as new but has
clearly been used, marked, tampered with, or damaged prior to its return, NAGCC reserves the
right to refuse to issue the refund.

Refund Process
Where the Seller is NAGCC, the purchase amount, net of any applicable deductions, will be
refunded to you using the same payment method used during the purchase, within 7 to 14
working days from the approval of the refund.

Order Cancellation Policy
The terms below apply to Products held in stock and include Products stored or held outside
the UAE.
To ensure delivery of the desired Products in the shortest lead time, NAGCC starts
processing orders from the moment they are confirmed. Hence a request to cancel or change an
order may not be feasible or acceptable in certain cases. Furthermore, logistics, locked-in
pricing for ordered products, and obligations toward third-party suppliers may impact
NAGCC’s ability to accept a cancellation or change request. Therefore, please read the below
carefully and contact us if you have any queries,
Subject to the terms and conditions contained below, generally:
- The parties may, by mutual written consent, agree to cancel the product at any
time.

To cancel an order, Buyer shall always require the Seller’s consent.
-
Seller may cancel an order without obligation, liability to, or consent from the
Buyer.
To request cancellation of an order, the Buyer must send a request in writing to the NAGCC
via email or the appropriate NAGCC’s Platform functionality, requesting to cancel all or
part of a non-executed pending order and which shows the status "Pending Fulfillment" in the
Buyer’s Account.
Upon receiving such notification, the Seller shall stop any work in respect of the said
order forthwith and advise the Buyer in writing whether the cancellation order can be
accepted (including any applicable conditions for such cancellation), or not.
The Buyer may cancel an order without any obligations towards the Seller, if:
- the cancellation request is received before the status of the order indicates “ready
to ship”, or “order being prepared”, and in no case later than 24 hours from the
order confirmation by the Seller.

Seller breaches the terms of the order, or if the Seller will not be able to perform
the order, especially due to Seller’s financial position.

The seller is behind with the performance of the whole or part of the order or
contractual obligations by more than 7 days
Except as otherwise provided herein, or agreed by the Seller in writing, an order cannot be
revoked or canceled if it has been accepted for processing or has been executed.
Where a cancellation request has been approved but the Seller has already incurred costs and
expenses that cannot reasonably be recovered through the sale of the products to another
entity, Buyer will pay Seller for all such costs and expenses, which may include costs of
related raw materials, packaging, shipping and any other costs or expenses related to the
order fulfilment. In such cases, Seller may deduct such costs from any amounts pre-paid by
the Buyer, or otherwise held on the Buyer’s account.
Stock items
When the shipping date of the Product has been agreed by the parties, or specified by the Buyer,
or notified by the Seller, changing or canceling an order will only be considered if the request
is received by Seller (i) before the status of the order indicates “order being prepared” or
“ready to ship” and (ii) the request is received by Seller within no later than 24 hours from
the confirmation of the order.
Intellectual Property
All the online materials are NAGCC’s intellectual property and are protected by the Intellectual
Property Laws prevailing in the UAE. The on-line materials may not be copied or redistributed
either in whole or in part without the prior written consent of NAGCC, except as expressly and
specifically permitted under these Terms of Use.
All rights, titles, and interests in and to the on-line materials are vested solely in NAGCC.
Under no circumstances will you have any right, directly or indirectly, to own, use, copy, loan,
sell, rent, lease, license, sublicense, redistribute, assign or otherwise convey these
Materials, or any rights thereto, except as expressly and specifically provided in the Terms of
Use.
Disclaimer of Warranties
Your use of this Site and services are at your own risk. The Site and services are offered on an
“as is” and “as available” basis. We expressly disclaim whether express, implied, statutory or
otherwise, with respect to the service, including all implied warranties of merchantability,
fitness for a particular purpose, title and non-infringement, and warranties that may arise out
of course of dealing, course of performance, usage or trade practice.
Without limitation, NAGCC provides no warranty or undertaking, and makes no representation of
any kind that the service will meet your requirements, achieve any intended results, be
compatible or work with any other software, applications, systems or services, operate without
interruption, meet any performance or reliability standards or be error free or that any errors
or defects can or will be corrected, the accuracy, reliability, or currency of any information
or content provided through the service and the content, or e-mails sent from or on behalf of
the NAGCC are free of viruses, scripts, trojan horses, worms, malware or other harmful
components.
Limitation of Liability
Our Liability and your exclusive remedy, with respect to the Site content, services purchased
and/or for any breach of this Terms of Use is solely limited to the amount paid by you for the
services purchased from our Site.
We will not be liable for any direct, indirect, incidental, special or consequential damages,
lost profits or business interruption in connection with this Terms of Use or Services in any
manner arising out of (1) the use or the inability to use this site and avail use of any the
services on our Site; (2) the use of or inability to use the service and Site; (3) any services
availed and/or purchased or transactions entered into through the Site;
Some jurisdictions do not allow exclusion of certain warranties or limitations of liability, so
the above limitations or exclusions may not apply to you. The liability of the NAGCC would in
such case be limited to the greatest extent of liability permitted by law.
Privacy

Indemnity
You agree to indemnify and hold NAGCC, its officers, agents, and other partners and employees,
harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, made
by any third party due to or arising out of or relating to your use of the Site, including also
your use of the Site to provide a link to another site or to upload content or other information
to the Site, or your breach of the Terms of Use.
License Granted
By providing materials to NAGCC to be uploaded on the Site or materials for use on the Site, you
warrant that you expressly grant NAGCC an irrevocable world-wide license and right to use and
exploit all the materials provided by you. NAGCC may publish and distribute the materials by any
method at its sole discretion.
Agreement to be bound
By using this Site or subscribing or purchasing our services, you acknowledge that you have read
and agree to be bound by this Terms of Use and all Terms of Use on this Site.
Severability and Waiver
Severability
If any provision of these Terms of Use is held to be unenforceable or invalid, such provision
will be changed and interpreted to accomplish the objectives of such provision to the greatest
extent possible under applicable law and the remaining provisions will continue in full force
and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an
obligation under this Terms shall not effect a party's ability to exercise such right or require
such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver
of any subsequent breach.
Termination
We reserve the right to terminate your use of the site or suspend your access immediately,
without prior notice if you breach any of these Terms of Use.
Upon termination, your right to use the Service will cease immediately.
Governing Law and Jurisdiction
The laws of Dubai shall govern the use of the Site and this Terms of Use. Unless otherwise
determined by NAGCC, all issues arising in connection therewith shall only be heard by a court
of competent jurisdiction in the UAE.
